TERMS OF SERVICE
This online shop (hereinafter "Shop") is operated by Valora Switzerland AG, Hofackerstrasse 40, 4132 Muttenz, Switzerland ("Valora").
The offer of the shop is sent to the customer at the available delivery times to the designated delivery areas in Switzerland.
The present general terms and conditions (hereinafter referred to as “AGBs”) apply to all offers in the shop.
All rights and obligations in connection with the shop according to these terms and conditions apply exclusively between Valora and the customer.
The range is decisive at the time of the order.
Valora reserves the right to make adjustments to the range at any time. Depending on the delivery location, the range offered may differ.
Valora also reserves the right to limit the order quantity for certain products or product categories.
3. Order task / contract conclusion
Orders are made exclusively via the shop. There is no entitlement to the use of the shop.
Ordering the shop is reserved for legal persons.
In the shop, the customer can select the products he wanted and place them in his virtual shopping cart. The customer (provided that any minimum order value has been reached) is then guided by the ordering process via the shopping cart.
As part of the ordering process, the customer selects the delivery period.
After successfully completing the ordering process, the customer will be confirmed by email.
A contract between the customer and Valora is only concluded with the order confirmation by Valora. Valora is free to not accept an order - for whatever reason - and to refuse its confirmation.
The data required for the order are to be specified completely and truthfully by the customer and is responsible for its correctness and completeness. With the submission of the order, the correctness of all information is confirmed.
An e-newsletter with current news or special promotions can be sent several times a year to the email address specified in the order process, unless the customer rejects the preservation of the e-newsletter during the ordering process by deactivating the corresponding tick box.
If the customer gives his consent, he can revoke them at any time by logging in to the corresponding link in the footer of the e-newsletter by clicking on the corresponding link.
5. Subsequent changes to orders by the customer
Subsequent changes to orders that have already been confirmed are not possible.
6. Cancellation of orders by Valora
If the successful delivery is not possible for reasons that are not responsible for Valora (e.g. wrong delivery address, lack of access permit, bad weather or traffic conditions, etc.) or only under difficult conditions, Valora is entitled to cancel the order. Any claim of the customer for damage or real replacement is fully excluded.
If the customer is responsible for the circumstances (e.g. incorrect delivery address), there is also no entitlement to reimbursement of the purchase price and/or shipping costs and also not on subsequent delivery.
7. Availability of products and incomplete fulfillment of the order
We strive to ensure the availability of the products offered in the shop and to deliver all ordered products in sufficient number and high quality.
In exceptional cases, it can still happen that for various reasons there are not enough goods available or cannot be released for delivery. In this case applies:
- If products are not available at the time of the order, the customer will be informed about this or
- If products are not available at the time of delivery or collection, they are neither sent nor are replacement items delivered. The effectively obtained goods are specified on the definitive delivery note and on the invoice.
The customer is not entitled to any real or compensation entitlement in the event of shortened or unadorned quantities.
If an article is not delivered, the customer can report to our customer service within 7 days since receipt of the order confirmation (Section 15) so that the corresponding amount can be credited to him.
8. Minimum order value
There is no minimum order value for the order.
Valora reserves the right to change the minimum order value at any time. Details can be found in the information in the shop at the time of the order delivery.
9. Shipping costs
Shipping costs of CHF 4.90 are incurred per order for delivery. Shipping is free of charge from an order value of CHF 20.
10. Prices and payment conditions
The prices as they are displayed in the shop at the time of the order are decisive. All prices are in Swiss francs including the applicable VAT.
Payment is made by credit card via Valora's payment service provider Stripe, whereby Valora is entitled to add additional means of payment and/or to consult other payment service providers.
When the order is completed, the credit card is authorized. The effective debit takes place immediately. If a debit is not possible, the products ordered are not delivered.
Which payment methods can be selected is displayed for selection during the order during the order.
The customer bears the sole responsibility for using the specified means of payment (e.g. credit card).
No vouchers for payment can be accepted in the shop.
The invoice and the delivery note (or the receipt) are provided after delivery. This is done either by email or by side dish in paper form when the goods are delivered.
11. Deliveries and delivery times
Goods are delivered directly to the delivery address provided by the customer and contact person on the agreed delivery date during the selected delivery period by the Valora delivery service.
Valora does everything possible to adhere to the delivery periods. However, all delivery times announced in the shop only serve as an orientation.
A non -compliance with the delivery deadlines does not entitle the customer to a withdrawal of the contract or compensation. If the delivery is delayed, the goods will be stored in accordance with the customer in accordance with Section 12.
12. Stop deliveries
For quality and security reasons, Valora strives to personally hand over the delivery to the customer. However, the customer entitles Valora to deposit the order in the event of its absence.
When ordering the customer, the customer can specify in the "Note for ordering" field, where the delivery is to be deposited. Without the appropriate information, the goods are deposited according to the best option where the parcel service deposits packages for such addresses (e.g. in the package compartment of the mailbox, in front of the house or apartment door). Under no circumstances will Valora take the order with them again.
With the handover of the goods, or landfilling of the goods, the benefits and danger (in particular the risk of theft, damage to third parties and environmental influences) to the customer.
13. Product declaration
The product information published in the shop is updated regularly and with the greatest care. In exceptional cases, this information can differ from the information actually printed on the packaging (e.g. for short periods of recipe changes). In this case, the information on the packaging is always decisive.
Since changes in recipe can be made at any time, we recommend our customers to regularly consult the list of ingredients on the packaging and to pay attention to the allergy notice.
In the event that the information on the packaging deviates from the information in the shop at the time of the order and the customer cannot consume the product due to deviating allergen information, the customer has the right to request the credit value of the relevant goods value. Our customer service (Section 15) must be contacted for this.
14. Ensuring data communication
According to the current state of the art, data communication via the Internet cannot be guaranteed without errors and/or available at any time. Valora is not liable for the constant and uninterrupted availability of the shop or for technical and electronic errors during a transaction, especially not for the delayed processing or acceptance of orders.

Defects in the products ordered must be objected to when receiving the goods. Otherwise, the goods are considered to be flawless by the customer. Covered defects must be objected to our customer service within 7 days of their discovery.

Valora can change these terms and conditions at any time. The terms and conditions published at the time of the order apply.
The German text is decisive for any ambiguities and/or contradictions between different language versions.
If parts of these terms and conditions prove to be unexpected or invalid, the validity of the other provisions will not be affected.
It is exclusively applicable Swiss law. The place of jurisdiction is Basel-Stadt or at the customer's residence.
